SCHEDULE C <br /> <br />ADDITIONAL TERMS AND CONDITIONS <br /> <br />The Concord Telephone Company hereby agrees to the additional terms <br />and conditions to the attached agreement: <br /> <br />The Concord Telephone Company (herein after called LESSOR) <br />agrees to cancel this lease without penalty or additional <br />payment in the event it is necessary to upgrade the system <br />covered by this lease due to the need for advanced software not <br />deliverable by the manufacturer or the manufacturer's inability <br />to provide maintenanc~ support and/or components needed to build <br />the system to its design capacities. The LESSEE acknowledges <br />that this offer is contingent upon the LESSEE upgrading with a <br />suitable substitute system provided by the LESSOR at reasonable <br />rates based on then competitive costs for current technology. <br />In the event that the LESSOR cannot provide substitute <br />technology needed at competitive rates, both parties agree that <br />the lease may be canceled without penalty or further payments. <br />If the lease is canceled without an upgrade provided by the <br />LESSOR, the LESSEE agrees to reimburse the LESSOR for the cost <br />of removal of system components covered by this lease. <br /> <br />The Concord Telephone Company Cabarrus County Home Health Agency <br /> <br />Name Name <br />Title Title <br />Date Date <br /> <br /> <br />
