Planning and Zoning Commission Minutes <br />August 18, 1994 <br /> <br />Page 19 <br /> <br />Mr. Ieter asked in our planning function is this a majority vote? <br /> <br />The Chair said the board's decision can rest if we have a three quarter super <br />majority and it is not appealed by an aggrieved party within 15 days. Seven, <br />eight or nine. A simple majority, it goes on to the Commissioners. <br /> <br />The Chair opened the public hearing on Petition 94-04. <br /> <br />Ms. Kimberly Schriefer, Planning Staff, addressed the Board presenting Petition <br />94-04 and the Staff Analysis stating the property does lie along a major <br />thoroughfare and it will fall under the regulations of the Thoroughfare Overlay <br />Zone which require that the property and the business be accessed off Jim <br />Sossoman Road. A minimum of 175 feet from the right-of-way. The planning <br />staff does not feel that this use if granted, would create any increased traffic <br />impact on either Jim Sossoman Road or the intersection along U.S. Highway 601 <br />South. The staff recommends approval of this petition with the following <br />conditions: <br /> <br />1. The petitioner needs to add or retain wooded area along north property line <br />as a buffer between adjacent property on U.S. Highway 601 South. <br /> <br />2. Construction of the residence should occur before or in conjunction with <br />construction of the storage facility. <br /> <br />3. Adherence to the modified development plan. <br /> <br />Ms. Stafford said to Ms. Schriefer that she mentioned about having the resident <br />built in conjunction with the storage facility. She said if she understands it right, <br />the petitioner is going to do the storage facility in phases. Is the resident to be <br />built with the first part of the storage facility2 <br /> <br />Ms. Schriefer said yes. <br /> <br />Mr. Samuel Wilson, Petitioner, addressed the Board stating he plans to build his <br />house first before he starts this facility. He said any change that the board would <br />recommend at this time he can do. He said he is retired and this is going to be <br />his occupation when he moves to Cabarrus County. He said he tried to keep this <br />residential looking, he does not want it to look business. <br /> <br /> <br />
