Planning and Zoning Commission Minutes <br />August 18, 1994 <br /> <br />Page 24 <br /> <br />Mr. Smith said he has a question about that. Mr. Jeter said it is going to increase <br />the traffic that is not imperative with the road itselP. He said he believes that that <br />road can handle much more traffic that his business would ever put out. <br /> <br />Mr. Jeter said he is not questioning the road, but he is looking at the performance <br />base standard and he thinks in terms of impact, it is beyond what the standard <br />allows. <br /> <br />Mr. Smith said Mr. Jeter needs to think on that one. He said if that is the case <br />then he is saying that we cannot put mini-storage places any where in the County. <br /> <br />Mr. Jeter said no, he is looking at the performance base standards for rural home <br />occupation under low density residential. He said what he is looking at is what <br />is accepted in this area now. In other words, a resident in this area now can <br />come in and do anyone of these without coming before the board. He thinks this, <br />therefore, is our standard of what these people have a right to rely on because <br />that is where they are living and the zone that they are in. They should have a <br />right to rely on what the standards says if the zone has not changed. <br /> <br />The vote was 6 to 3 to deny Petition 94-04. Mr. Dwiggins, Ms. Ronda. Il, Mr. <br />Brownlow, Mr. Jeter and Mr. Smith for denial of this petition. Mr. Drye, Ms. <br />Harkey, and Ms. Stafford in opposition of the motion. Mr. Allison was absent, <br />his vote is counted as for the motion. <br /> <br />The Chair said this is a 6 to 3 vote to deny this petition. In this case, we have <br />a simple majority, but not what is called a super majority. This vote will go in <br />front of the Board of Commissioners. They will meet on September 19, 1994. <br />We will take this vote and the Chair's presentation to them. She will present as <br />impartially and as fairly as she can the logic for the vote, and they will have the <br />final decision. <br /> <br />The Chair introduced the seventh item on the Agenda, Zoning Atlas Amendment, Petition 94-05: <br /> <br />Applicant: Kenneth Wayne Hartsell <br />Request: Petition 94-05 <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mr. Kenneth Wayne Hartsell, to have his property located on U.S. Highway <br />601 South approximately 630' south of N.C. Highway 24-27 rezoned from <br /> <br /> <br />
