The previous case that the board saw would have been permitted as <br />a rural home occupation with a slightly smaller building. <br /> <br />The Chair said she would like to remind the board that we do need to find <br />findings of fact associated with our recommendation in our motion since this is <br />a special use. <br /> <br />The Chair said she is concerned about this for the same reason she was concerned <br />about other kinds of changes to a zone that is a non-residential zone in an area <br />that is 3 miles north of a commercial zone and easily a mile south of the Concord <br />Motor Speedway which is an area in itself, but is not necessarily a commercial <br />zone of a limited nature. That is her biggest concern. <br /> <br />Mr. Brownlow said the Midland Area Plan and the zoning of this area to low <br />residential was set after 3 meetings in Midland, where it was discussed how the <br />people of Midland wanted their area to develop. This is contrary to the plan. <br /> <br />The Chair closed the public hearing on Petition 94-04. <br /> <br />There being no further comments the Chair MOTIONED to deny Petition 94-04 <br />based on these findings of fact: <br /> <br />1. There is a negative impact on the surrounding property owners. <br /> <br />2. It does not comply with the intent of the area plan. <br /> <br />3. There is no contiguous or even nearby other kind of commercial zone around. <br /> <br />4. There is no sanitary sewer. <br /> <br />The Motion was seconded by Mr. Brownlow. <br /> <br />Mr. Jeter said he agreed with the motion, but he is not sure any of those were <br />findings of fact. He added as a finding that this business would increase the <br />traffic beyond the spirit of the standard. He said he thinks it would impact the <br /> <br /> <br />
