NORTH CAROLINA <br /> <br />CABARRUS COUIqTY <br /> <br />MODIFICATION OF LEASE <br /> <br /> THIS MODIFICATION OF LEASE, made this the day of <br /> <br />September, 1994, by and between the BOARD OF COUNTY COMMISSIONERS <br />OF CABARRUS COUNTY, a body corporate and politic, hereinafter <br />called "Cabarrus County," and HISTORIC CABARRUS, INC., a non-profit <br />corporation organized and existing under the laws of the State of <br />North Carolina, having its principal office in the City ~f Concord, <br />Cabarrus County, North Carolina, hereinafter called "Historic <br />Cabarrus;" <br /> <br /> W I T N E S S E T H: that-- <br /> <br /> WHEREAS, the parties hereto entered into a certain Lease <br />relative to the property known as the "Old Cabarrus County <br />Courthouse," on February 7, 1994 (hereinafter the "Lease"), a copy <br />of which is hereto attached and made a part hereof; and <br /> <br /> WHEREAS, said parties wish to modify the Lease to provide <br />enhanced and cost-effective insurance coverage for the Demised <br />Premises; <br /> <br /> NOW, THEREFORE, Cabarrus County and Historic Cabarrus mutually <br />agree as follows: <br /> <br /> 1. Section 3 of the Lease is amended to read as follows: <br /> <br /> 3. As the owner and as a named insured, Cabarrus <br /> County will purchase and keep in force liability <br /> insurance in such amounts and against such <br /> hazards as may be necessary or desirable and will <br /> insure the Demised Premises against fire and <br /> windstorm for the use and benefit of Historic <br /> Cabarrus, the County or otherwise, as their <br /> interests may appear; provided that Historic <br /> Cabarrus will fully reimburse Cabarrus County for <br /> the cost of this insurance. <br /> <br /> <br />
