Planning and Zoning Commission Minutes <br />October 20, 1994 <br /> <br />Page 2 <br /> <br />He said the parcel in question would be divided from a 7 acre parcel wh/ch is <br />currently accessed by a 25 foot right-of-way off of N.C. Highway 73 East, just <br />to the east of Walker Road. <br /> <br />The Chair asked Mr. Marshall if that was an approved right-of-way, and if it <br />had to go through an exception request? <br /> <br />Mr. Marshall said at the time that lot was divided out, exempted single <br />splits. That was a case where a lot was divided and a right-of-way extended <br />to it and it was exempt from the subdivision regulations. Our update of the <br />subdivision regulations in 1991, removed that exemption because by State <br />law there was no way we could exempt single splits. <br /> <br />Mr. Marshall said this is a road that is of good quality and the petitioner is <br />requesting just one lot to be divided out of this, and staff would recommend <br />that this exception request be approved. <br /> <br />There being no further comments, Ms. Harkey MOTIONED, seconded by Mr. <br />Smith to approve Petition 94-04(S). The vote was 6 to 1, The Chair in <br />opposition. <br /> <br />The Chair introduced the second item on the Agenda, Zoning Atlas Amendment. <br /> <br />Applicant: Mr. Max Lee Conner <br /> <br />Request: Petition 94-07(SU) <br /> <br />The Chair said the board is still in the planning board function, but since this <br />is a special use request, the board has a certain degree of quasi judicial <br />responsibility in this capacity. She asked if anyone would like to speak <br />tonight, to come forward and be sworn in. <br /> <br />She then swore in Mr. Allen Brooks, Operations Manager for Conner <br />Trucking Company, Mr. H.J. Harmon, Ir., Property Owner, Ms. Terri Wood, <br />Resident, Ms. Kimberly Schriefer, Planning Technician, Mr. Joe Hartsell, <br />Property Owner, and Mr. Dan Buchanan, Property Owner. <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mr. Max Lee Conner to have his property located on the southwest <br />corner of Cabarrus Station Road and Bethel Avenue Extension, <br /> <br /> <br />
