Planning and Zoning Commission Minutes October 20, 1994 Page 3 PIN 5534.04-83-6155, rezoned from Low Density Residential to Limited Industrial Special Use, so he can use his existing structure as a dispatch office for a trucking company and use of the property as a parking facility for the trucks used in the operation. Ms. Kimberly Schriefer, Staff Member, addressed the Board presenting Petition 94-07 and Staff Analysis stating this rezoning came about as the result of a zoning enforcement action to correct an illegal use of a trucking business in a residential zone. Ms. Schriefer said there are two concerns that the staff raised in review of this petition. The first being a transportation issue and the second being compatibility with the surrounding land uses and intent of the Midland area plan. She stated it is the opinion of the staff that from a land use standpoint the intensity of this use would not be suitable or compatible with the rural/residential character of the adiacent properties. She said it is the recommendation of the staff that this petition be denied. The recommendation is being made on the following: 1. The site is not in, nor is it located near a commercial or industrial area; and, based on the "Midland Area Plan", would not be compatible with the surrounding land uses or/at harmony with the intent of the Plan. 2. From a transportation safety standpoint, considering the width, topography, and limited sight distances of the roads as well as several one lane bridges which would be crossed in travel to and from the site, we feel that the roads and bridges would not support the vehicles. The Chair opened the Public Hearing on Petition 94-07(SU). Mr. Allen Brooks, Operations Manager for Conner Trucking Company, addressed the Board stating that the entrance to the plant would not be Cabarrus Station Road, they would use Bethel Avenue Extension. He said their plans for operation is from 8 a.m. until 6 p.m. He said they are a licensed ICC common carrier. They have both common and contract rights. They are a truck load carrier, they do not carry LTL freight. That means that they do not unload or off load any materials at all on the site, everything is carried from one point of destination to the next and nothing comes into the yard that is reused. What they carry is furniture, clothes, tires that go on automobiles and they do quite amount of business for grocery stores. Mr. Brooks said they are a benefit to Cabarrus County in their payroll, because those dollars are turned back into Cabarrus County. He said that they do
