She said this became a non-conforming <br /> <br />Mr. Gerald NewtOn, Planning Director for Cabarrus County, introduced <br />himself to the citizens stating that the property itself that they are looking at <br />is not the location for this business. He said back to the larger question about <br />the business at another location, there was a complaint that the business had <br />gone beyond what it had been approved for in the old ARR zoning. It had <br />gone past its permitted scope of the old zoning as well as the current zoning. <br />It was not grandfathered in, and a lot of evidence had been shown as to the <br />type of operation that was there in 1982 when zoning first came into the <br />county. In 1983 ween it first started, there was a request to look at the <br />complaint. Through that process they were required to stop the trucking <br />operation that had expanded over the years. This is a direct result of their's <br />as an effort to try to come up with another location, but it is not this property. <br /> <br />Ms. Harkey thanked Mr. Newton for the clarification. <br /> <br />The Chair said there was a motion on the floor to deny the petition. The vote <br />was unanimous to deny Petition 94-07. <br /> <br />The Chair stated that any person who considers himself of herself an <br />aggrieved party has the right to appeal this ruling and finding by this board <br />to the Board of County Commissioners. That appeal by any aggrieved party <br />must be submitted to the County Manager's Office within fifteen (15) days. <br />If there is no appeal, this vote will be final. <br /> <br />The Chair introduced the third item on the Agenda, Zoning Atlas Amendment: <br /> <br />Applicant: Ralph S. & Rachel Christy <br />Request: Petition 94-08 <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Ralph S. & Rachel Christy, PIN 5600.02-78-1880, located on Bailey Lake <br />Road (former Bailey's fishing lake and fish camp), to have their property <br />rezoned from Medium Density Residential to Limited Commercial Special <br />Use, for reuse of a barn to rent facilities for meetings such as family or class <br />reunions, receptions, seminars, etc. <br /> <br /> <br />
