Planning and Zoning Commission Minutes <br />October 20, 1994 <br /> <br />Page 7 <br /> <br />Mr. Brooks said he would like to say that they have not moved into this <br />community just presently, they have been operating since 1978, almost 14 <br />years, and he does not think that anyones land value has fallen over the last <br />14 years. <br /> <br />The Chair closed the Public Hearing on Petition 94-07(SU). <br /> <br />There being no further comments, Mr. Jeter MOTIONED to affirm the <br />recommendation of the staff and deny Petition 94-07 incorporating as <br />findings of fact the information presented by the staff to include the VCR <br />tape, the maps, the testimony of those present tonight, and the Assessments <br />in the Staff Analysis, seconded by Mr. Smith. <br /> <br />The findings of fact are: <br /> <br /> 1. Compatibility of surrounding uses: It is the opinion of the staff that <br />from a land use standpoint the intensity of this use would not be suitable or <br />compatible with the rural/residential character of the adjacent properties. <br /> <br /> 2.. Traffic problems associated with the development: As stated <br />above, adequacy of the current road systems to support the vehicles as well <br />as traffic safety. <br /> <br /> 3. Consistency with the Cabarrus Comprehensive Plan: The <br />"Midland Area Plan' designates this area for rural/residential use (map <br />attached). Industrial and commercial uses have been focused along the major <br />thoroughfares of US Highway 601 South and NC Highway 24/27. The <br />proposed use would not be consistent in any way with the intent of the <br />Comprehensive Plan. <br /> <br />4. VCR Tape. <br /> <br />5. The Maps <br /> <br />6. Testimony of those that were present at the meeting. <br /> <br />Ms. Harkey said for clarification, if this business has been operating since <br />1978, why are'they coming now for a rezoning, she asked if they would not <br />be grandfathered? <br /> <br /> <br />
