PETITION 92-03(t)

A TEXT AMENDMENT TO AMEND SECTION 3.12, WATERSHED OVERLAY DISTRICT
OF THE CABARRUS COUNTY ZONING ORDINANCE

Background

On August 17, 1992, Cabarrus County received the final information
regarding the impacts of the new watershed classifications. In May
of 1992, the North Carolina Environmental Management Commission
(EMC) adopted a revised version of statewide watershed regulations.
Portions of five drinking water sources exist in Cabarrus County
and need to be closely regulated.

Existing Ordinance

Cabarrus County already was voluntarily complying with earlier
watershed regulations and therefore already has an existing section
in the Cabarrus County Zoning Ordinance (Section 3.12). However,
three other watershed have also been classified by the EMC and need
to be inserted into the existing ordinance.

It should also be noted that the zoning ordinance accomplishes many
of the provisions of the statewide regulations. It does not meet
all provisions and is not designed to do so. Agricultural
activities will be regulated through the Soil and Water
Conservation Commission. The NC Division of Forestry will address
silvaculture, the Division of Environmental Management, and
Division of Solid Waste Management all of the Department .of
Environmental, Health, and Natural Resources will also oversee many
of the items.

Proposed Ordinance

The following text is being proposed tQ be modified as shown. The
bracketed areas or underlined areas show the addition to the
existing ordinance. These revisions have been made t° bring the
zoning ordinance regulations into compliance with the areas of
protection as shown in the "Public Water Supply Watersheds of the
North Carolina Environmental Management Commission." Coddle Creek
and Dutch Buffalo Creek Reservoirs are officially classified as WS
II ~hi!e Lake Ccnccrd, Lake Fisher, and ~ucke~to~n Reservoir
(located in Stanly County) have been classified as WS IV. The
critical area and the protected watersheds are shown in the
attachments.

Once these amendments
reviewed by the EMC
revisions.

Gerald A. Newton, AICP
Director ,

have been enacted they will need to be
for compliance and they may need future
