3.12 Watershed Overlay (WSO) District <br /> <br />-The provisions of this district shall apply within the areas <br />designated as a Public Water supply Watershed by the North Carolina <br />Environmental Management Commission. The designated areas are <br />established on the map entitled "Watershed Protection M,,ap of <br />Cabarrus County, North Carolina" ~hich is adopted simultaneously <br />with this section. Any and all amendments to this overlay district <br />shall take effect and be in force at the date of enactment by the <br />cabarrus County Board of Commissioners. <br /> <br /> All lots in the following watersheds: <br /> <br />1. Coddle Creek <br />2. Dutch Buffalo Creek <br /> <br />shall meet the following requirements: <br /> <br /> 1. All lots within the drainage basin?s critical area, <br /> that is land within 1/2 mile of the hic/~water markJ <br /> for the reservoirs shall have a minimum lot size of <br /> two (2) acres. ~f a cluster develop_~e_D.t__~s___a,p~proved, <br /> the density_.,f_ox~_,t_h._e~,~e_~!]~.~._!.~ r.e~i_.n_ ~5.e...~...d?_~e~l_l_i_n..g pe.r <br /> two (2) acres for development. I <br /> <br /> 2. All lots ~or dwelling units per acre in cluster <br /> develcpments~in the remaining area of drainage basin <br /> for the reservoirs sha~li have a minimum square footage <br /> of 40,000 square feet[(or 40,000 square feet per dwelling <br /> unit density~ or meet requirements of the cabarrus County <br /> Zoning Ordinance, whichever is more stringent. <br /> <br />In addition, the following requirements shall apply to property <br />within the drainage basin, within 1/2 mile of the high water mark <br />for reservoirs: <br /> <br />1. No commercial or industrial development shall be <br /> permitted. <br /> <br />A 150 foot vegetative buffer shall be maintained from <br />the normal pool level on all property adjoining the <br />reservoir, no permanent structures shall be allowed <br />in this buffer area. <br /> <br />A stream buffer shall be established on all perennial <br />streams as detailed in the River/Stream Overlay Zone <br />section of this ordinance. <br /> <br />All non-single family residential and non-residential <br />development of lots within the critical area shall have <br />a built upon area of less than six percent (6%). <br /> <br /> <br />
