AMEND THE LAWS OF NORTH CAROLINA TO LIMIT <br />3 CERTAIN UNFUNDED REGULATORY MANDATES TO COUNT[ES AND <br />J. CITIES BY THE STATE OF NORTH CAROLINA AND TO AMEND THE <br />S GENERAL STATUTES TO MAKE MANDATORY THE PREPARATION OF <br />6 FISCAL NOTES FOR PROPOSED REGULATIONS THAT COULD REQUIRE <br />7 COUNTIES AND CITIES TO SPEND FUNDS. <br />8 The General Assembly of North Carolina enacts: <br />9 Section I. G.S. I$0B-I9 reads as rewritten: <br />l0 "§ I~0B-19. Restrictions on what can be adopted as a rule. <br />11 An affency may no! adopt a rule dmt does one or more of the following: <br />12 (I) Implements or interprets a law uu[ess that law or another law <br />IJ speci[ica)ly authorizes the agency to do so. <br />It {2) Enlarges the ~cope of a profession, occupation, or Held o1: endeavor <br />15 [or tt. hich an occupational license is required. <br />16 {3) Imposes crlmin:H liabilit? or a civil penalty [or aq act or omis.~ion, <br />17 iucluding tl~e violation ul' a rule. unless a law spet'ifically. <br />I~ authorizes H~e agency to do ~o or a law declares thai violation Gl' <br />19 the rule is ,'I crimi,)al ,;rfense or is grounds for a civil penalty. <br />20 (4) Repeats the content of a la,,~, a rule, or a federal regulation. <br /> <br /> <br />
