or (2) if the Contractor is a private agency, expenses charged for travel shall not exceed those which would be allowed under the rules of the United States Government governing official travel by its employees. In any event, per diem other than mileage, for activities within a 50 mile radius of the Contractor is not allowable unless prior written approval is recei~,ed from the Grantee. 4. Publication and Publicity. The Contractor may publish results of its function and participation in the approved State Plan without prior review by the Grantee, provided that all such publications, interviews, news releases, and other communications of ,similar nature contain the following language: "Sponsored by .Cabarrus County Department of Aqincl., in cooperation with the North Carolina Energy Division, Department of Commerce, with funds granted by the Weatherization Assistance Program, pursuant to Part A, Title IV of the National Energy Conservation Policy Act (NECPA) Public Law 95-619. However, any opinions, findings, conclusions, or recommendations expressed herein are those of the author(s) and do not necessarily reflect the views of the U.S. Department of Energy or the North Carolina Depadment of Commerce." Three copies of each such publication, interview, news release or other communication shall be furnished to the Grantee. 5. Copyri.qhts. tf the Contract results in a book or other copyrightable material, the author is free to copyright the work, but the DOE and the Grantee reserve a royalty-free, nonexdusive and irrevocable license to reproduce, publish, or otherwise use, and to authorize others to usa, all copyrighted material and all material which can be copyrighted resulting from the Contract. 6. Patents. Any discovery or invention arising out of or develope~l in the course of work aided by this Contract shall be promptly and fully reported to the Grantee for determination as to whether patent protection on such invention or discovery shall be sought and how the rights in the invention or discovery, including rights under any patent issued thereon, shall be disposed of and administered, in order to protect the public interest. 7. Covenant Against Contin.qent Fees. The Contractor warrants that no person or selling agency or other organization has been employed or retained to solicit or secure this Contract upon an agreement or understanding for a commission, percentage, brokerage, or contingent fee. For breach or violation of this warrant, the Grantee shall have the right to annul this Contract without liability or, in its discretion, to deduct from the compensation, or otherwise recover, the full amount of such commission. 8.
