employment in the performance of this Contract because of race, sex, age, creed, color, <br />physical handicap or national origin. The Contractor will take affirmative action to ensure <br />that applicants are employed, and that employees are treated during employment, without <br />regard to race, sex, age, creed, color, physical handicap or national origin. This <br />requirement shall apply to, but not be limited to, the following: employment, upgrading, <br />demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of <br />pay or other forms of compensation; and selection for training, including apprenticeship. <br />In the event that the Contractor signs any contract which would be covered by Executive <br />Order 10925 (March 6, 1961) or Executive Order 11114 (June 22, 1963), the Contractor <br />shall include the equal-employm, ent opportunity clause specified in section 301 of <br />Executive Order 10925, as amended. The Contractor will comply with the regulations <br />promulgated by 10 CFR 1040 entitled "Non~discrimination in Federally Assisted <br />Programs", which implements the following public laws: Tide VI of the Civil Rights Act of <br />1964; Section 16 of the Federal Energy Administration Act of 1972; the Age Discrimination <br />Act of 1975; and Section 504 of the Rehabilitation Act of 1973. <br /> <br />9. Political Activity Prohibited. None of the funds, materials, property or services <br />contributed by the Agency or the Contractor under this Contract shall be used in the <br />Performance of this Contract for any partisan political activity, or to further the election or <br />defeat of any candidate for public office. <br /> <br />10..Religious. Activity Prohibited. There shall be no religious worship, instruction or <br />proselytization as part of or in connection with the performance of this Contract. <br /> <br />11. Compliance with Local Laws. The Contractor shall comply with all applicable laws, <br />ordinances, and codes of the State and local governments. <br /> <br />12. Property Mana.qement Standards. Use and disposition of Nonexpendible PersOnal <br />Property shall be in accordance with Attachment N to Office of Management and Budget <br />Circular A-102. Nonexpendible Personal Property is defined as "tangible personal <br />properly having a useful life of more than one year and an acquisition cost of $200.00 or <br />more" (and which prior written approval by the Grantee is required). The Contractor <br />agrees, that title to all Nonexpendible Personal Property purchased with funds provided <br />for the project described in Part III of this Agreement shall rest in the Grantee and upon <br />completion or termination of the project for any reason such property shall, upon demand, <br />be delivered to the Grantee. The Contractor fudher agrees that the Grantee shall incur no <br />liability for incidents involving property purchased with funds under this contract, and <br />agrees to hold the Grantee harmless in the event that claims are presented and upheld <br />against the Grantee. <br /> <br />13. Repods and Inspections. The Contractor shall make financial, program progress, and <br />other reports as requested by the Grantee or the Secretary of the DOE, and will arrange <br /> <br />-9- <br /> <br /> <br />
