Dr. Hartgen said lot 119 does not have the contours there either. <br />He asked if they would have to build behind the sanitary sewer. <br /> <br />The chair MOTIONED to approve River Hills Estates III-1 subdivision <br />plat final, seconded by Mr. Brownlow. <br /> <br />Mr. Amos said in the first finding of fact, Mr. Marshall used the <br />term when community water or sewer is provided. He said they only <br />require one or the other not both. <br /> <br />Mr. Marshall said to reduce to 30,000 square feet it is either/or, <br />if you want to reduce further, you can reduce to 20,000 square feet <br />with both water and sewer. <br /> <br />The vote to approve River Hills Estates III-1 subdivision plat <br />final was unanimous. <br /> <br />The Chair stated to the citizens the Board is now moving to the <br />zoning atlas amendment, what is typically called rezonings. She <br />stated that this board serves in this capacity as an advisory board <br />to the County Commissioners. This board makes final decisions on <br />subdivision reviews. This board will hear public input on this <br />petition. This petition is to rezone land from a residential zone <br />to a commercial zone, special use, and after we hear all of that, <br />we will vote on it and make a recommendation to the County <br />Commissioners. The County Commissioners will be taking sworn <br />testimony at their meeting which is on November 15, 1993, and they <br />will make the final decisions on this zoning atlas amendment. <br /> <br />The Chair introduced the fourth item on the Agenda, Petition 93-10: <br /> <br />Applicant: Brian F.S. Wickens <br />Request: Rezoninq of Property from R-30 to C-3 SU <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from J.A. & Patti Fisher, Owner - Brian F.S. Wickens, <br />Petitioner, PIN 5610-18-6865, 18-7864, to have their property <br />located on Poplar Tent Road approximately 250 feet east of Rock <br />Hill Church Road, rezoned from R-30 to C-3 SU, to construct an <br />automobile repair garage. <br /> <br />Mr. Marshall, Staff Member, presented Petition 93-10 and staff <br />analysis to the Board stating there is one change in the concept <br />plan that he would like to note. The petitioner shows almost <br />completely around the perimeter a proposed 6 foot wooden fence, the <br />petitioner would be required to screen his business from any <br />residentially zoned property. The board could permit that <br />screening to be natural vegetation, rather than having that 6 foot <br />wooden fence all the way around the perimeter. It could be <br />constructed from Poplar Tent Road back even with the asphalt <br />parking lot, rather than going 700 feet down one property line, 200 <br />feet on another property line and approximately 300 feet on <br />another.
