8. PUBLICATIONS <br /> <br /> a. UNIVERSITY will be free to publish results of the RESEARCH <br />PROGRAM and otherwise make public copyrightable materials relating to the <br />RESEARCH PROGRAM. Provided, however, that nothing herein contained shall <br />entitle UNIVERSITY to publish any COUNTY information which is confidential <br />within the meaning of Paragraph 11 hereof, without the prior written consent <br />of COUNTY. <br /> <br /> b. UNIVERSITY shall provide the COUNTY a copy of each proposed <br />publication containing information or data arising from the RESEARCH PROGPJ%M, <br />and COUNTY shall within sixty (60) days of receipt of such proposed <br />publication, notify UNIVERSITY in writing whether it wishes a patent <br />application to be filed on the subject matter of such Publication; but in no <br />event shall publication be delayed beyond six (6) months from submission of <br />the proposed publication to COUNTY. <br /> <br />9. PATENT SOL/CiTATION <br /> <br /> a. In the event COUNTY requests the filing of a patent <br />application pursuant to Paragraph 6(d) or 8(b) hereof, UNIVERSITY at its <br />option shall proceed with such filing, and any publication shall be delayed <br />for a time sufficient for filing of one or more U. S. applications, as <br />requested by the COUNTY. COUNTY shall bear all out-of-pocket cost incurred in <br />connection with such preparation, filing, prosecution, and maintenance of U. <br />S. and foreign application(s). COUNTY may consult with UNIVERSITY to assure <br />that such application(s) will cover, to the best of COUNTY's knowledge, all <br />items of commercial interest and importance, University shall use its best <br />efforts to provide COUNTY with a copy of each proposed original application in <br />good time for comment prior to the filing thereof. While UNIVERSITY shall be <br />responsible for making decisions regarding scope and content of application(s) <br />to be filed and prosecution thereof, UNIVERSITY shall keep COUNTY advised as <br />to all developments with respect to such application(s) and shall promptly <br />supply to COUNTY copies of all papers received and filed in connection with <br />the prosecution thereof in sufficient time for COUNTY to comment thereon. <br /> <br /> b. Should UNIVERSITY elect not to file patent applications <br />pursuant to sub-paragraph (a) hereof, UNIVERSITY shall notify COUNTY in <br />writing within 30 days of receipt of a request to file by COUNTY, in which <br />case COUNTY may at its own expense file and prosecute U. S. and foreign patent <br />applications in the UNIVERSITY'S name; and in such case UNIVERSITY shall delay <br />publication for no more than 90 days from the date of such notification to <br />COUNTY. However, in no case shall students' dissertations or theses be held <br />up such that graduation could be delayed. Thereafter, UNIVERSITY shall do all <br />things necessary to assist COUNTY's patent attorneys or agents in connection <br />with filing and/or prosecution of any application for Letters patent, and <br />UNIVERSITY shall be provided with a copy of each proposed original application <br />for comment in advance of filing. <br /> <br /> c. ~f COUNTY elects not to file such application(s) or to <br />discontinue the financial support of the prosecution or maintenance of the <br />protection, UNIVERSITY shall be free to continue prosecuting or maintaining <br />any such application(s) and to maintain any protection issuing thereon in the <br />U. S. and in any foreign country at UNIVERSITY's sole expense, and shall be <br />free to license the patent rights to third parties. <br /> <br /> 10. CgPYRIG~TS. Title to and the right to determine the <br />disposition of any copyrightable material first produced or composed in <br />performance of the R~$EARCH PROGRAM shall remain with UNIVERSITY provided that <br />UNIVERSITY shall grant to COUNTY and its affiliates a worldwide, royalty-free, <br />revokable for cause, nonexclusive right and license to use such materials <br />internally or with prior written permission other ways. <br /> <br /> <br />
