city of Concord <br />Community Development Program <br /> <br />REHABILITATION WORK CONTRACT (GENERAL) <br /> <br />THIS AGREEMENT, made this the 6th day of January, 1992, by and <br />between Cabarrus County, Department of Aging, hereinafter called the <br />"Contractor" and Fannie Mae Patton, of Cabarrus County, North <br />Carolina, hereinafter called the "Owner." <br /> <br />WITNESSETH, that the Contractor and the Owner for the consideration <br />stated herein mutually agree as follows: <br /> <br />1. STATEMENT OF WORK The Contractor shall furnish all supervision, <br />labor, materials, machinery, tools, equipment, and services, and <br />perform and complete all work required for rehabilitation and/or <br />repairs in an efficient and' workmanlike manner on the property <br />located at 30 Sunderland Road, Concord, North Carolina, all in <br />strict accordance with Work Write-Up dated December 2, 1991 and <br />drawings for this rehabilitation work. <br /> <br />2. CONTRACT PRICE The undersigned Contractor proposes to furnish <br />labor, materials, and equipment complete in accordance with the <br />above Statement of Work and the General Specifications for the sum <br />of $9,347. <br /> <br />3. METHOD OF PAYMENTt GUAP~tNTEE <br /> <br /> A. INTERIM PAYMENT - Upon application of Contractor, interim <br />payments may be made in amounts not to exceed eighty percent (80%) <br />of the value of work in place as determined. <br /> <br />B. FINAL PAYMENT - Final payment will be made only after: <br /> <br /> (1) The Contractor executes a lien release and warranty on a <br />form to be furnished by the Owner relative to the work performed, <br />materials furnished, and certification that all amounts due for <br />labor and/or repairs have been paid. The Contractor by execution of <br />this Agreement will hold the Owner harmless from all claims or liens <br />for labor or materials furnished or used in the performance of the <br />work covered by this Contract, whether furnished or used by the <br />Contractor or any subcontractor; and <br /> <br /> (2) Final inspection by the Community Development Department, <br />Designee and approval and acceptance by the Owner of all work per- <br />formed by the Contractor. In the event that the performance by the <br />Contractor is unsatisfactory and unacceptable for any reason, the <br />Contractor agrees to undertake to correct such deficiencies as noted <br />at no additional cost to Owner. <br /> <br /> (C) GUARANTEE - The Contractor will guarantee the work per- <br />formed for a period of one year from the date of final acceptance of <br />all work required by the Contract.
