furnish the Owner with all manufacturers' and suppliers' written <br />guarantees and warranties covering materials and equipment furnished <br />under the contract. <br /> <br />4. TIME FOR COMPLETION The work which the Contractor is required <br />to perform under this contract shall be commenced as stated on the <br />Proceed Order and shall be fully completed within thirty (30) <br />consecutive calendar days following such commencement. Prior to <br />commencement of work, the Contractor shall be given written notice <br />of the date said work will commence. Each working day after the <br />completion date will represent a $25 fine, deducted from the final <br />payment. Failure to commence or complete the work as herein <br />provided shall be considered a material breach of this contract <br />unless a written change order is executed by Contractor or Owner. <br /> <br />5. CARE OF WORK The Contractor shall exercise proper precaution at <br />all times and shall be responsible for all damages to persons or <br />property, either on or off the premises, that occur as a result of <br />his fault or negligence in connection with the result of his fault <br />or negligence in connection with the prosecution of the work. The <br />Contractor shall be responsible for the proper care and protection <br />of all work performed until completion and final acceptance, whether <br />or not the same has been covered in whole or in part by payments <br />made by the Owner. <br /> <br />6. INDEMNIFICATION OF OWNER The Contractor shall indemnify and <br />save harmless the owner from liability for any injury or damages to <br />persons or property resulting from his prosecution of work under <br />this contract. <br /> <br />7. INSURANCE The Contractor shall car~y the following insurance <br />and submit a certificate of coverage prior to the execution of this <br />contract. Failure to maintain the insurance shall be grounds for <br />termination of the agreement. <br /> <br />Comprehensive General <br /> <br />Bodily Injury Liability <br />Property Damage Liability <br /> <br />$100,000 per occurrence <br /> 100,000 aggregate <br /> 25,000 per occurrence <br /> 25,000 per occurrence <br /> <br />S. ENCUMBRANCES The Owner shall not encumber the property or make <br />any conveyance of the property without the written consent of the <br />Contractor while this contract is in force. <br /> <br />9. INSPECTIONS The Community Development Department Designee, and <br />other authorized representative of the City of Concord shall have <br />the right to inspect the work while in progress and at the comple- <br />tion thereof. The Contractor shall remove or uncover such portion <br />of the finished work as required by the Community Development <br />Designee during inspections. After inspection, Contractor will <br />restore the finished work and correct any unacceptable work at no <br />expense to Owner. The Owner and Contractor will permit the U.S. <br />Government or its Designee to examine and inspect all rehabilitation <br />work. <br /> <br /> <br />
