furnish the Owner with all manufacturers' and suppliers' written guarantees and warranties covering materials and equipment furnished under the contract. 4. TIME FOR COMPLETION The work which the Contractor is required to perform under this contract shall be commenced as stated on the Proceed Order and shall be fully completed within thirty (30) consecutive calendar days following such commencement. Prior to commencement of work, the Contractor shall be given written notice of the date said work will commence. Each working day after the completion date will represent a $25 fine, deducted from the final payment. Failure to commence or complete the work as herein provided shall be considered a material breach of this contract unless a written change order is executed by Contractor or Owner. 5. CARE OF WORK The Contractor shall exercise proper precaution at all times and shall be responsible for all damages to persons or property, either on or off the premises, that occur as a result of his fault or negligence in connection with the result of his fault or negligence in connection with the prosecution of the work. The Contractor shall be responsible for the proper care and protection of all work performed until completion and final acceptance, whether or not the same has been covered in whole or in part by payments made by the Owner. 6. INDEMNIFICATION OF OWNER The Contractor shall indemnify and save harmless the owner from liability for any injury or damages to persons or property resulting from his prosecution of work under this contract. 7. INSURANCE The Contractor shall car~y the following insurance and submit a certificate of coverage prior to the execution of this contract. Failure to maintain the insurance shall be grounds for termination of the agreement. ENCUMBRANCES The Owner shall not encumber the property or make any conveyance of the property without the written consent of the Contractor while this contract is in force. 9. INSPECTIONS The Community Development Department Designee, and other authorized representative of the City of Concord shall have the right to inspect the work while in progress and at the comple- tion thereof. The Contractor shall remove or uncover such portion of the finished work as required by the Community Development Designee during inspections. After inspection, Contractor will restore the finished work and correct any unacceptable work at no expense to Owner. The Owner and Contractor will permit the U.S. Government or its Designee to examine and inspect all rehabilitation work.
