10. RESPONSIBILITIES OF OWNER <br /> <br /> A. The Owner will permit the Contractor to use at no cost <br />existing utilities such as light, heat, power, and water necessary <br />to carrying out and completion of the work. <br /> <br /> B. The Owner or his Tenant will continue to occupy the <br />premises during the course of the construction work. If temporary <br />displacement occurs, it will be handled in accordance with the <br />Uniform Relocation Act. <br /> <br /> C. The Owner or his Tenant, if any, will cooperate with the <br />Contractor to facilitate the performance of the work, including the <br />removal and replacement of rugs, curtains, coverings, and furniture <br />as necessary. <br /> <br />11. WRITTEN CHkNGE ORDERS No changes concerning the work to be <br />performed under the terms of this contract shall be valid or binding <br />upon the Parties hereto except in accordance with the following <br />procedures. <br /> <br /> A. The Contractor and the Community Development Department <br />Designee shall prepare a written change order describing all <br />additional work to be performed and/or work to be deleted with the <br />additional or reduced cost, if any, notes on each item or work <br />described. <br /> <br /> B. The Change Order so prepared shall be signed by the <br />Contractor and the Owner. <br /> <br /> C. The signed Change Order shall be submitted for approval to <br />the Community Development Department or the designated agent. Only <br />after approval by the Community Development Department or its desig- <br />nated agent shall the written Change Order be binding and effective <br />as to the Parties, and the change in work performed or deleted. <br /> <br />12. ROOFING In the event the Work Write Up which is attached <br />and forms a part of this contract requires new roofing to be <br />installed, then the Contractor shall first remove the existing <br />roofing material. After inspection and approval by the Community <br />Development Department Designee, the Contractor shall then install <br />the new roofing material as required by the Work Write Up. <br /> <br />13. PAINTING No Contractor shall use or permit the use of <br />lead-based paint on applicable surfaces of HUD-associated housing. <br />If lead-based paint exists, treatment shall be taken to eliminate <br />all hazards. This shall consist of the coverning or removal of <br />defective paint surfaces. If lead-based paint is discovered, <br />the Contractor will comply with the lead-based paint regulations, <br />which will be made available to the Contractor from the Community <br />Development Department. <br /> <br />14. DELAYS AND INABILITY OF CONTRACTOR TO PERFORM The following <br />shall be deemed grounds for termination of this contract: <br /> <br />Substantial and unjustified delays in work without <br />approval of the joint parties: or <br /> <br /> <br />
