B. Contractor or his subcontractors are found incapable <br /> of performing the class of work specified= or <br /> <br />E® <br /> <br />The inability of the contractor to secure sufficient <br />and adequate financing to perform this work= or <br /> <br />Decease of Contractor or dlssolution under the partner- <br />ship of corporate laws of North Carolina= or <br /> <br />Insolvency or Bankruptcy. <br /> <br />Contractor's noncompliance with the nondiscrimination <br />clauses of this contract. <br /> <br /> The Contractor will be notified in writing five (5) days in <br />advance if in violation of one of the above items and if the <br />violation is not corrected during this period, the contract shall be <br />terminated. The Community Development Director or his designated <br />agent will determine the value of work completed at termination and <br />issue a final payment. <br /> <br />15. EQUAL EMPLOYMENT OPPORTUNITY The Contractor shall not dis- <br />criminate against any employee or applicant for employment because <br />of race, color, religion, sex, handicap, family status, or national <br />origin. The Contractor shall take affirmative action to insure <br />that applicants for employment are employed, and that employees are <br />treated during employment, without regard to their race, color, <br />religion, handicap, family status, sex or national origin. Such <br />action shall include, but not be limited to, the following: employ- <br />ment, upgrading, demotion, or transfer; recruitment or recruitment <br />advertising; layoff or termination; rates of pay or other forms of <br />compensation; and selection for training, including apprenticeship. <br />The Contractor shall incorporate or cause the foregoing provisions <br />to be incorporated in all subcontracts for any project work covered <br />by this contract so that such provisions will be binding upon each <br />subcontractor. <br /> <br />The Contractor shall, in all solicitations or advertisements for <br />employees placed by or on behalf of the Contractor, state that all <br />qualified applicants will receive consideration for employment <br />without regard to race, color, religion, sex, handicap, family <br />status, or national origin. <br /> <br />16. POLICY OF NONDISCRIMINATION No persons in the United States <br />shall on the ground of race, color, national origin, sex, family <br />status or handicapped be excluded from participation in, be denied <br />the benefits of, or be subjected to discrimination under any program <br />or activity funded in whole or in part with funds available under <br />this title. <br /> <br />17. CONFLICT OF INTEREST Interest of Members, Officers, or <br />Employees of the Recipient, Members of Local Governing Body, or <br />Other Public Officials. No member, officer, or employee of the <br />recipient, or its agents,'no member of the governing body of the <br />locality in which the program is situated, and no other public <br />official of such locality or localities who exercises any functions <br />or responsibilities with respect to the program during his tenure or <br /> <br /> <br />
