for one year thereafter, shall have any financial interest, are <br />direct or indirect, in any contract or subcontract, or the proceeds <br />thereof, for work to be performed in connection with the program <br />assisted under this agreement. Immediate family members of said <br />members, officers, employees, and officials are similarly barred <br />from having any financial interest in the program. The recipient <br />shall incorporate, or cause to be incorporated, in all such <br />contracts or subcontracts, a provision prohibiting such interest <br />pursuant to the purpose of this section. <br /> <br />18. RESOLUTION OF DISPUTES In the event that there is any question <br />or dispute in respect to the interpretation or the manner of imple- <br />mentation of this agreement or related documents, or relating to the <br />execution and progress of the work, the parties hereto agree that <br />the City of Concord Community Development Coordinator shall resolve <br />any such dispute and such resolution shall be final and binding upon <br />the parties. Upon learning of such a dispute, the City of Concord <br />Community Development Coordinator shall provide a statement in <br />writing resolving the dispute to each party within ten (10) days of <br />learning of said dispute. <br /> <br /> If a finding is made in favor of the Contractor, but the Owner <br />does fail and refuse to execute a Certificate of Completion on <br />Contractor's work or to complete any act whereby payment can be made <br />on Owner's behalf to Contractor, then Owner's rights of withholding <br />payment will be considered waived and payment will be made to <br />Contractor. <br /> <br /> If a finding is made in favor of the Owner but the Contractor <br />does not take the necessary corrective action within ten (10) days <br />as needed to satisfy the finding, then the Contractor's right to any <br />unpaid claims or retention shall be considered waived and the Owner <br />shall have the right to use such funds to take such remedial action <br />as is necessary. <br /> <br />19. COPELAND "ANTI-KICKBACK" ACT PROVISION Each Contractor or sub- <br />grantee shall be prohibited from inducing, by any means, any person <br />employed in the construction, completion, or repair of public work, <br />to give up any part of the compensation to which he is otherwise <br />entitled.
