STAFF ANALYSIS - PETITION 92-03 <br /> <br />The petitioner is requesting a change in zoning from the current <br />ARR zoning to a special use heavy industrial zoning - I-2/SU. The <br />purpose of this request is to bring the zoning of the property into <br />alliance with the (current use). A racetrack along with accessory <br />uses is currently operated on the property. <br /> <br />There are a number of issues to be considered in the analysis of <br />this rezoning. Among these are the basic issues of the <br />appropriateness of the requested zoning in terms of transportation, <br />utilities, current property use, and long range plans for thearea. <br />In addition, the special use request allows additional information <br />to be submitted with the application and it allows a more specific <br />analysis of the use and its ability to comply with Zoninq Ordinance <br />performance standards. The petitioner has been notified that they <br />should consider providing more information concerning these issues. <br />(See Attachment "A") <br /> <br />BACKGROUND <br /> <br />The petitioner is currently operating a non-conforming racetrack on <br />the property along with conditionally approved accessory uses. The <br />racetrack predates zoning in the County and therefore no <br />conditional use permit (as required under ARR zoning) has been <br />required for the track itself. Additions and accessory buildings <br />that have been added since the adoption of zoning have required a <br />conditional use permit. If the zoning is changed, the track and <br />accessory uses would be permitted outright and require only zoning <br />compliance and building permits. <br /> <br />SERVICES <br /> <br />Analysis of the request must include a discussion of the basic <br />factors affecting the zoning of the property. The property is <br />located on U.S. 601 the main north-south highway between <br />Concord/Kannapolis and Monroe, and is approximately four miles from <br />both N.C. 49 and N.C. 24/27. A County water line is located on the <br />front of the property at U.S. 601, although the facility is no <br />using the County water service. It is recommended that connection <br />to County water be considered as a condition to this rezoning. The <br />racetrack uses septic tanks for wastewater treatment since sewer <br />service is not available. All of these factors support the special <br />use zoning request. <br /> <br />CURRENT AND LONG RANGE LAND USE <br /> <br />Current property use and the recently completed Midland Area Plan <br />both indicate that non-residential zoning and uses are appropriate <br />for this area. As mentioned previously, the speedway predates <br />zoning. The long range plan indicates that this area is best <br />suited for non-residential use, at least partially because of the <br />speedway being located there, as long as proper services are <br /> <br /> <br />
