abarrus County <br /> heriff's <br /> <br />February 24, 1992 <br /> <br />Mr. John Witherspoon <br />County Manager <br />Cabarrus County <br /> <br />Dear Mr. Witherspoon; <br /> <br /> I have received your request for information regarding <br />legislative goals. <br /> <br />I would suggest that the counties again seek increased fee <br />rates for the service of Civil Process. <br /> <br />The legislature increased the fee from $4.00 to $5.00 last <br />year but this is still the lowest service fee on the east <br />coast of the U.S. that I am aware of. <br /> <br />The fee should be at least $15.00 for true civil process <br />(Civil Summons, Writ of Possession For Real or Personal <br />Property, Claim & Delivery, Attachments, Etc.) <br /> <br />Subpoenas for appearances in civil and criminal courts are <br />acceptable at the $5.00 rate since most can be handled by <br />telephone. <br /> <br />The jail fees for confinement of state prisoners was increased <br />to $14.50 but this is still too low. It should be closer to <br />$30.00 per day to truly reflect the actual cost. <br /> <br />Another aspect that should be of high priority is the cost of <br />medical care provided by the Department of Corrections for <br />inmates who we send to them on Safekeeping orders under N.C. <br />General Statute 162-39 (Copy Attached). We use this to place <br />an inmate in the prison system when it is apparent that there <br />will be extended medical treatment of the inmate. We do not <br />have the manpower nor the facilities to securely house an <br />inmate during extended medical treatments. We currently do not <br />have to pay the cost of the medical treatment. We do have to <br />pay to DOC the cost of housing the inmate at the same rate <br />they pay us for housing a state prisoner ($14.50). We use <br />this to defray the cost of major medical care provided to <br />inmates when we have time to transfer them. <br /> <br />DOC has attempted to bill some counties for these expenses. <br /> <br /> 6 <br />P.O.
