Based on current legal advice the counties are not obligated <br />to pay the medical cost under the safekeeping statute. <br />We (Cabarrus County) have not had to use DOC for this purpose <br />because we have not had the time to get some of our inmates <br />sent there instead of to the local hospital. <br /> <br />DOC will probably be tryinq to get legislation amended or new <br />leqislation adopted to pass their medical treatment bill on to <br />the counties. The counties should adopt a position against <br />this effort. <br /> <br />DOC at Central Prison has on staff medical personnel who can <br />treat most any problem including major surgery. If an inmate <br />'is legally in their custody, whether on' commitment or on a <br />safekeeping order, they should assume the medical care of the <br />inmate. <br /> <br />Another area that the local board will want to be involved in <br />is the Confinement of All Misdemeanents in the local jails. <br /> <br />Being a member of both the N.C. Sheriffs' Association <br />Executive Committee and N.C. County Commissioners Association <br />Criminal Justice Committee, I am aware that the state <br />associations are monitoring this development closely and will <br />be working together to minimize the financial impact on the <br />counties. <br /> <br />i would imagine that all the counties will want to put up a <br />unified position through the state association on this issue. <br /> <br />If our board needs further information from me on this issue <br />please let me know. <br /> <br /> Thanks for soliciting the County Department head input on <br />these matters.
