M E M O RAN D UM

TO:

FROM:

JOHN V. ~VITHERSPOON
COUNTY MANAGER
DON MOORHEAD ~
PERSON~EL OFFICER

DATE: MARCH 9, 1992

SUBJECT: LEGISLATIVE GOAL RECOMMENDATION

I recommend the amendment of G.S. 153A-98. Privacy of employee
personnel records, to clarify that information on North Carolina county job
applicants is not a matter of public record. This is important to ensure that
counties will receive the fullest response to job advertisements; especially those in
the professional and executive categories.

In July 1991, Yadkin County Superior Judge William Freeman ruled that the
Tribune, an Elkin newspaper, could have access to the info,,nation on the
applicants for the Yadldn County Manager's position. While the North Carolina
Court of Appeals has overruled this decision, it would be prudent to clarify this
Statute to prevent future misinterpretations. This clarification might take the form
of:

The addition to the last sentence in subsection (a), "As used in this
section, 'employee', includes former employees of the county but
not applicants for employment."

The addition of a new subsection that stales, "Release information of
an individual nature which could reasonably be expected to identify
a job applicant may not be disclosed without approval of the
concerned indMdual(s).

If you have any questions, please let me know.

DM:jys

Attachment

Office o1' lhe County Manr, ger
P.O.
