Privacy of employee <br />personnel records, to clarify that information on North Carolina county job <br />applicants is not a matter of public record. This is important to ensure that <br />counties will receive the fullest response to job advertisements; especially those in <br />the professional and executive categories. <br /> <br /> In July 1991, Yadkin County Superior Judge William Freeman ruled that the <br />Tribune, an Elkin newspaper, could have access to the info,,nation on the <br />applicants for the Yadldn County Manager's position. While the North Carolina <br />Court of Appeals has overruled this decision, it would be prudent to clarify this <br />Statute to prevent future misinterpretations. This clarification might take the form <br />of: <br /> <br />The addition to the last sentence in subsection (a), "As used in this <br />section, 'employee', includes former employees of the county but <br />not applicants for employment." <br /> <br />The addition of a new subsection that stales, "Release information of <br />an individual nature which could reasonably be expected to identify <br />a job applicant may not be disclosed without approval of the <br />concerned indMdual(s). <br /> <br />If you have any questions, please let me know. <br /> <br />DM:jys <br /> <br />Attachment <br /> <br /> Office o1' lhe County Manr, ger <br />P.O.
