Planning and Zoning Commission Minutes <br />April 16I 1992 <br /> <br />Paqe 6 <br /> <br />approximately .4 miles west of U.S. 601 rezoned from ARR <br />to 0-I, to use existing land and building as a real <br />estate office. <br /> <br />Mr. Marshall, Staff Member, presented Petition 92-05 and <br />Staff Analysis to the board stating the staff recommends <br />approval of this petition based on the recommendations of <br />the Midland Area Plan, the existing zoning pattern, and <br />the existing land uses. <br /> <br />Chairperson Randall opened the public hearing on Petition 92-05 <br />asking if anyone would like to speak for or against this petition. <br /> <br />Ms. Brenda Farmer, Petitioner, addressed the board <br />stating it is important for them to get this property <br />rezoned. <br /> <br />Mr. Shultz asked Mr. Marshall in regards to the new <br />highway, if this would impact the useability of this <br />site. <br /> <br />Mr. Marshall stated no. The existing right-of-way is 100 <br />feet in width and the proposed right-of-way is 200 feet <br />in width, so it would be an extra 50 feet on that side. <br />The house is well enough off the road that it would be <br />unaffected by that. Mr. Marshall said by our <br />thoroughfare overlay zone, they would be limited to that <br />single access unless they had a DOT permit that showed <br />reason to require another access point. The highway not <br />be limited access. <br /> <br />Mr. Shultz asked if the board was promoting a strip type <br />of development by extending out that distance from the <br />intersection rather than including that in some kind of <br />a cluster in the immediate vicinity of the intersection. <br /> <br />Chairperson Randall said she would respond from that <br />respect that she has always been concerned about having <br />this road not turned into Independence Boulevard. She <br />said she is more concerned about the driveway cuts that <br />would allow that and she would have preferred it to be <br />limited access, but DOT did not see it that way. <br />Chairperson Randall said she sees it twofold and she <br />supports this petition for that reason. One is that this <br />O-I zone will serve in a fashion at least as a buffer <br />from some of the existing residential that is to the west <br />of this property. In addition, she said she attended <br />everyone of those Midland Area Plan meetings. The people <br />that attended those meetings, and they were the best <br />attended meetings of any small area plan yet that we have <br /> <br /> <br />
