12 <br /> <br /> g. Maintaining an animal that habitually or repeatedly chases, snaps <br /> at, attacks or barks at pedestrians, joggers, animals walked on a <br /> leash by owners, bicycles or other vehicles. <br /> <br /> h. Failing to confine a female dog or cat while in heat in a <br /> <br /> building or secure enclosure in such a manner that she will not <br /> be contact with another dog or cat , or attract other animals; <br /> provided, this section shall not be construed to prohibit the <br /> intentional breeding of animals within an enclosed area on the <br /> premises of the owner of the animal which is being bred. <br /> <br /> In addition to any other enforcement remedies available under this <br /> ordinance, if the Director/Supervisor declares an animal to be a nuisance <br /> under this section, then the Director/Supervisor has the authority to <br /> order the owner to confine the animal in accordance with the Director/ <br /> Supervisor's instructions. It shall be unlawful for the owner to fail to <br /> comply with such an order or with the instructions in the order. <br /> <br />Section 10o Vicious Do~s. <br /> <br /> (1) Confinement. The owner of a vicious dog shall not suffer or permit <br /> the dog to go unconfined. Provided, however, that the owner of a <br /> vicious dog may petition a veterinarian practicing in Cabarrus County <br /> to evaluate the animal and determine whether or not the animal meets <br /> the definition of vicious. The veterinarian may request an exemption <br /> for the animal with full understanding that the exemption makes the <br /> veterinarian and not the county liable for any further vicious <br /> behavior by the animal in question. <br /> <br /> (2) Leash and Muzzle. The owner of a vicious dog shall not suffer or <br /> permit the dog to go beyond the premises of the owner unless the dog <br /> is securely muzzled and restrained by a chain or leash, and under the <br /> physical restraint of a person. The muzzle shall be made in a manner <br /> that will not cause injury to the dog or interfere with its vision or <br /> respiration, but shall prevent it from biting any human or animal. <br /> <br /> <br />
