Page 8 of 15 <br /> <br /> (b) I~archase by the Contractor. ~e Contractor may purchase project <br />equipment utilizing procurement procedures set forth in North Carolina <br />General Statute 143-129, and ~ Circular 4220.1B, and any subsequent <br />amendments or revisions thereto. The Contractor shall submit Invitations To <br />Bid and Requests For Proposals to the Depar~nent for review and approval. <br /> <br /> If formal advertising is used for a procurement, the Contractor shall <br />submit to the Department a tabulation of all bids received, certified by an <br />authorized official of the Contractor's organization; copies of <br />correspondence pertaining to exceptions to the approved specifications; and <br />a copy of the bid submitted by the low, responsive bidder reconnmnded for <br />the bid award by the Contractor. The Department sh~ll approve the bid award <br />prior to the execution of any agreement between the Contractor and the <br />selected bidder. <br /> <br /> Section 9. Title to Vehicles. The Certificate of Title to all <br />vehicles purchased under the Project shall be in the name of the Contractor. <br />The Public Transportation Division shall be recorded on the Certificate of <br />Title as first lienholder. In the event of Project termination or breach of <br />Contract provisions, the Contractor shall, upon written notification by the <br />Department, surrender Project equipment and/or transfer the Certificate(s) <br />of Title for Project equipment to the Depart~nent or the Department's <br />designee. <br /> <br /> Section 10. Use of Pro~ect Equipment. The Contractor shall use all <br />project equipment for the duration of its useful life in the manner specified <br />in the Project description contained in the approved grant application. <br />With the prior written approval of the Department, Project equipment m~y be <br />used for other purposes provided that these other uses are consistent x~th <br />uses outlined in the Transportation Development Plan and do not interfere <br /> <br /> <br />
