In accordance ~ith Office of Management and Budget (Obi) Circular A-128, "Audits of State and Local Coverrment", dated April 2, 1985, and the Single Audit Act of 1984, the Contractor shall arrange for an independent financial and c~liance audits of its fiscal operations. The Contractor shall furnish the Department with a copy of the independent audit report ~ithin thirty (30) days of cc~letion of the report, but no later than one (1) year after the end of the audit period. Section 7. Contracts Under This Agreement. Unless otherwise authorized in writing by the Department, the Contractor shall not assign any portion of the work to be performed under this Agreement, or execute any contract, amendment, or change order thereto, or obligate itself in any manner with any third party ~ith respect to its rights and responsibilities onder this Agreement without the prior written concurrence of the Department. Further, the Contractor shall incorporate the provisions of this Agreement into any vehicle lease arrangement and shall not enter into any vehicle lease arrangement without the prior concurrence of the Department. Any lease approved by the Department shall be subject to the conditions or limitations governing the lease of Project equipment as set forth by ~TA amd the Department. Section 8. Purchase of Pro~ect Equipment. The purchase of project equipment pursomnt to this Agreement shall be ondertaken in accordance with either of the options in this Section: (a) Purchase by the Department. The Department may act as the procurement agency on behalf of the Project, purchasing equipment through the North Carolina Department of Administration, Purchase and Contract Division.
