(iii) The basis for the pretreatment <br />limitations including the documentation of any <br />calculations in applying categorical <br />pretreatment standards. <br /> <br />Final Action On Wastewater Discharqe Permit Applications <br /> <br />(1) The Executive Director shall take final action on all <br />applications not later than 90 days following receipt of a <br />complete application. <br /> <br />(2) The Executive Director is authorized to: <br /> <br />(i) Issue a wastewater discharge permit containing such <br />conditions as are necessary to effectuate the purposes of <br />this ordinance and N.C.G.S. 143-215.1; <br /> <br />(ii) Issue a wastewater discharge permit containing time <br />schedules for achieving compliance with applicable <br />pretreatment standards and requirements; <br /> <br />(iii) Modify any permit upon not less than 60 days notice <br />and pursuant to Section 8.2 (g) of this ordinance; <br /> <br />(iv) Revoke any permit pursuant to Section 2.1 of this <br />ordinance; <br /> <br />(v) Suspend a permit pursuant to Section 2.1 of this <br />ordinance; and <br /> <br />(vi) Deny a permit application when in the opinion of the <br />Executive Director s~ch discharge may cause or contribute <br />to pass through or an upset of the wastewater treatment <br />plant or where necessary to effectuate the purposes of <br />N.C.G.S. 143-215.1. <br /> <br /> mg) Hearinqs <br /> <br />The Authority may utilize the hearing procedures as <br />~ection 2.1. <br /> <br />'designated in <br /> <br />1. Adjudicatory hearings. An applicant whose permit is <br />denied, or is granted subject to conditions he deems <br />unacceptable, shall have the right to an adjudicatory hearing <br />before a hearing officer designated by the Executive Director <br />upon making written demand, identifying the specific issues to <br />be contended, to the Executive Director within 30 days <br />following receipt of the significant industrial user permit. <br />Unless such demand is made, the decision on the application <br />shall be final and binding. The conditions/requirements in the <br />newly issued permit shall be in effect pending the <br />adjudicatory hearing, unless the hearing officer rules that <br /> <br />33 <br /> <br /> <br />
