the specific conditions/requirements in question should be <br />stayed pending the outcome of the hearing. <br /> <br />2. Appeal hearings. Any decision of a hearing officer made <br />as a result of an adjudicatory hearing held under paragraph <br />(1) above may be appealed, to the Board of Directors upon <br />filing a written demand within 10 days of receipt of notice of <br />the decision. Hearings held under this subordinance shall be <br />conducted in accordance with Section 2.1 (c). <br /> <br />3. Any person against whom a final order or decision of the <br />Board of Directors is entered, pursuant to the hearing <br />conducted under paragraph (2) above, may appeal from the order <br />or decision, within 30 days receipt of notice by registered or <br />certified mail of the order or decision, but not thereafter, <br />to the Superior Court of Cabarrus County. Upon such appeal the <br />Authority shall send a transcript certified by the Board of <br />Directors of all testimony and exhibits introduced before the <br />Board of Directors, the order or decision, and the notice of <br />appeal to the Superior Court. <br /> <br />(h) Permit Modification <br /> <br />(1) Modifications of permits shall be subject to the same <br />procedural requirements as the issuance of permits except as <br />follows: <br /> <br />(i) modifications of the monitoring program contained in <br />the permit; <br /> <br />(ii) changes in the ownership of the discharge when no <br />other change in the permit is indicated; <br /> <br />(iii) a single modification of any compliance schedule <br />not in excess of four months; and <br /> <br />(iv) modification of compliance schedules (construction <br />schedules) in permits for new sources where the new <br />source will not begin to discharge until control <br />facilities are operational. <br /> <br />ANy changes cr new conditions in the permit shall include a <br />reasonable time schedule for compliance. <br /> <br />34 <br /> <br />3 <br /> <br /> <br />
