10.2 Permitted Nondomestic Users In addition to the regular sewer service fees and charges, sewer surcharges shall be assessed to each permitted nondomestic user as applicable and in accordance with Section 5.8. The fees, including sampling and program fees, will be for the use of the sewer system to recover the cost incurred for the operation and administration of the pretreatment program and the treatment system. 10.3 Penalties for Failure to .Pay Payment of charges, fees, and assessments shall be made monthly and shall be due as specified on the bill. If any charges remain after the specified due date, a disconnection notice will be sent and a penalty will be applied to the.unpaid balance in accordance with the terms and conditions governing payments set by the Board of Directors. 10.4 Termination of Services If any changes remain, after the final due date set by the Executive Director in accordance with Board of Directors policy and procedures, water and sewer services may be terminated. Before services can be reinstated, the balance must be paid in full. SECTION 11 - IIPSET PROVISION Upset provision. A~y discharge which experiences an upset in operations which places the discharger in a temporary state 'of noncompliance with this chapter shall inform the Executive Director thereof immediately following first'awareness of the cor~nencement of the upset. Where such information is given orally, a %Titten follow-up report thereof shall be filed by the discharger within five (5) days. The report shall specify: (a) Description of the upset, the cause thereof and the upset's expected impact on the discharger's compliance status; (b) Duration of noncompliance, including exact dates and time of noncompliance, and if the noncompliance is continuing, the time by which compliance is reasonable expected to occur; and (c) Ail steps taken or to be taken to reduce, eliminate and prevent recurrence of such an upset or other conditions of ~ncompliance. 43
