(b) When requested by the person furnishing a report, the <br />portions of a report which might disclose trade secrets <br />processes shall not be made available for inspection by the <br />public but shall be made available upon written request to <br />governmental agencies for uses related to this ordinance, <br />NPDES permit, State Disposal System permit and/or the <br />Pretreatment Programs; provided, however, that such portions <br />of a report shall be available for use by the State involving <br />the person furnishing the report. Wastewater constituents and <br />characteristics will not be recognized as confidential <br />information. <br /> <br />(c) Information accepted as confidential, shall not be <br />transmitted to any governmental agency by the Authority until <br />and unless a ten day notification is given to the user. <br /> <br />8.7 Notification of Discharge of Hazardous Wastes <br /> <br />The industrial user shall notify in writing, the Executive <br />Director, the State, and EPA of any discharge into the wastewater <br />treatment plant of a substance, which, if otherwise disposed of, <br />would be hazardous waste under 40 CFR Part 261, in accordance with <br />40 CFR 403.12(p). <br /> <br />SECTION 9 - NEW CONSTRUCTION <br /> <br />New sewers and new connections shall be properly designated and <br />constructed in accordance with such guidelines as published by the <br />Environmental Protection Agency, reference 40 CFR section 35.927-4. <br /> <br />SECTION 10 - USER FEES <br /> <br />The Board of Directors shall approve all rates and fees to be <br />assessed to each user class. Every user of the sewer system will <br />pay the appropriate fees as determined by the Executive Director. <br /> <br />10.1 Residential, Commercial and Unpermitted Nondomestic Users <br /> <br />Regular sewer service fees and charges will be assessed to each <br />residential, commercial and unpermitted nondomestic user for the <br />use of the sewer systems to recover the costs incurred for the <br />operation and administration of the collection and wastewater <br />treatment systems. <br /> <br />42 <br /> <br /> <br />
