PETITION 92-03(t) <br /> <br />A TEXT AMENDMENT TO AMEND SECTION 3.12, WATERSHED OVERLAY DISTRICT <br />OF THE CABARRUS COUNTY ZONING ORDINANCE <br /> <br />Backqround <br /> <br />On August 17, 1992, Cabarrus County received the final information <br />regarding the impacts of the new watershed classifications. In May <br />of 1992, the North Carolina Environmental Management Commission <br />(EMC) adopted a revised version of statewide watershed regulations. <br />Portions of five drinking water sources exist in Cabarrus County <br />and need to be closely regulated. <br /> <br />Existinq Ordinance <br /> <br />Cabarrus County already was voluntarily complying with earlier <br />watershed regulations and therefore already has an existing section <br />in the Cabarrus County Zoning Ordinance (Section 3.12). However, <br />three other watershed have also been classified by the EMC and need <br />to be inserted into the existing ordinance. <br /> <br />It should also be noted that the zoning ordinance accomplishes many <br />of the provisions of the statewide regulations. It does not meet <br />all provisions and is not designed to do so. Agricultural <br />activities will be regulated through the Soil and Water <br />Conservation Commission. The NC Division of Forestry will address <br />silvaculture, the Division of Environmental Management, and <br />Division of Solid Waste Management all of the Department .of <br />Environmental, Health, and Natural Resources will also oversee many <br />of the items. <br /> <br />Proposed Ordinance <br /> <br />The following text is being proposed tO be modified as shown. The <br />bracketed areas or underlined areas show the addition to the <br />existing ordinance. These revisions have been made to bring the <br />zoning ordinance regulations into compliance with the areas of <br />protection as shown in the "Public Water Supply Watersheds of the <br />North Carolina Environmental Management Commission." Coddle Creek <br />and Dutch Buffalo Creek Reservoirs are officially classified as WS <br />II while Lake Concord, Lake Fisher, and Tuckertown Reservoir <br />(located in Stanly County) have been classified as WS IV.
