3.12 Watershed Overlay (WSO) District -The provisions of this district shall apply within the areas designated as a Public Water Supply Watershed by the North Carolina Environmental ~anagement Commission. The designated areas are established on the map entitled ~'Watershed Protection Map of Cabarrlls county, North Carolina" %~hich is adopted simultaneously with this section. Any and all amendments to this overlay district shall take effect and be in force at the date of enactment by the Cabarrus County Board of~omm~s'~ '~ loners. All lots in the following watersheds: 1 Coddle ~_eek 2. Dutch Euffalo creek Shall meet the follo¥~ing requirements: 1. All lots within the drainage basini's critical area, that is land within 1/2__jmile of the hig_~, water mar~j for the reservoirs shall have a minimum lot size of two (2) acres. !~f a cluster the densitz for the site shall remain one dwelling Der two (2) acres for development.[ 2. All lots ~or dwelling units per acre in cluster deve!cpments~ill the remaining area of drainage basin for the reservoirs shall ]lave a minimum square footage of 40,000 square feet ~or 40,000 square feet per dwelling unit density] or meet requirements of the Cabarrus Ccunty Zoning Ordinance, whichever is more stringent. In addition~ the following req~irements shall apply to property within the drainage basin, within 1/2 mile of the high water mark for reservoirs: 1. No con]mercial or industrial development shall be permitted. A 150 foot vegetative buffer shall be maintained from the ncrmal pool level cn all property adjoining the reservoir, nc permanent structures shall be allowed in this buffer area. A stream buffer shall be established on all perennial streams as detailed Jn the River/Stream Overlay Zone section of this ordinance. Ail non-single family residential and non-residential development of lots withi]~ the critical area shall have a built upon area of less than six percent (6%).
