5. No ind~strial or cor,]mercial hazardous material shall be <br /> used o'r stored in this 1/2 mile area. <br /> <br />For the remaining watershed area, the following requirements shall <br />be met: <br /> i. In all cases the development of lots within the balance of <br /> the watershed shall have a built upon area of less than <br /> twelve percent (12%). <br /> <br />2. A fifty (50) foot vegetative buffer shall be maintained <br /> adjacent to all perennial streams. <br /> <br />All land in the following watersheds: <br /> <br />Lake Concord <br />Lake Fisher <br />Tuckertown Reservoir <br /> <br />have been classified by the North Carolina Environmental ]~anagement <br />Commission as "Watersheds IV" drinking waters. As such, the <br />following requirements shall be met for all lots: <br /> <br />Unless prohibited by the underlying zoning district, <br />densities are permitted up to two (2) dwelling units <br />per acre. <br /> <br />Ail non-single family residential and non-residential <br />development land shall be permitted to build upon up <br />to 24% cf the site. <br /> <br />Any existing development within the watershed area may be <br />continued, as governed by other sections of the Zoning Ordinance, <br />and are subject to the following provisions: <br /> <br />vacant Lots. Platted but non-developed lots of record may <br />be used even if undersized. To the extent possible, <br />adjacent vacant lots under single ownership should be <br />combined or reconfigured to create one or more lots that <br />meet the standards of the ordinance. <br /> <br />o <br /> <br />Occupied lots. Platted and developed lots of record are <br />grandfathered lots. Any additions or new development on <br />these lots shall comply with the density/build-upon <br />standards. The existing non-developed land area of the <br />lot shall constitute the base from which the new <br />development standard is determined. <br /> <br />As with all enforcement and administration, the decision of the <br />Zoning Administrator may be appealed to the Cabarrus County <br />Planning and Zoning Commission serving as a Board of Adjustments. <br />Any appeal shall be reviewed by the Board under the standards used <br /> <br /> <br />
