,- JOINT RESOLUTION <br /> <br />A Joint-Re~olution By The City of Kannupo]is, Tile City of concord, The Town of Mount <br />~]easan~ and The County o~ caburrus, North Carolina Betting Forth a Stutel,c~t in Regard to <br />~he ClasBification of Water Supply Watersheds in and Around the Four Local Governments <br /> <br />WHEREAS, <br /> <br />the State of North C~rolina is in the process of instituting a progr.~m desig,:ed to <br />significmntly control development in water supply watersheds in order to ]~$sen <br />the potential of pollution within those watershed.~, and, hue, in fact, <br />preliminary watershed protection c]as$ificutions to the various local <br /> <br />WHEREAS, <br /> <br />the Four Local Governments are in general agreement with the purpose and intenl; cf <br />the State's progra~ll o~ protecting ~he local and statewide water supply resou£'cesy <br />and, <br /> <br />WHEREAS, <br /> <br />the Four Local Covernments are also cognizant of the need to balance environments] <br />protection requirements with the need for reasonable local growth and development <br />opportunities: and~ <br /> <br />WHEREAS, <br /> <br />the State of North Carolina has invited the Four Local Governments to co~l~i,ent on <br />the preliminary water supply watershed protection classifications and proposed <br />Rule changes; ~ <br /> <br />NOW THEREFORE, the City Council of the City of Kannapolis, the Board of Aldermen of the <br /> City of Concord, the Board of Col~%issioners of the Town of Mount Pleasant and the <br /> Board of Co~missioners of the County of Cabarrus do resolve as follows: <br /> <br /> :'hat the Water Supply Impoundment on Yadkin Coddle Creek now under <br /> construction and its drainage area from its source to the dar,, in the vicinity <br /> of NC 73 be classified as a WS II Watershed. <br />.'2. That the remainder of the Yadkin Coddle Creek Watershed be removed from Mater <br /> Supply Watershed designation. <br /> 3. That Kannapolis Lake on Yadkin Irish Buffalo Creek and its dr~inaoe area a'bove <br /> the dam be classified as a WS III Watershed. <br /> ~. That the portion of the Yadkin Coldwater Creek Water Supply Watershed draining <br /> below the dams on Lake Concord and Lake Fisher be removed from Mater Supply <br /> Watershed designation. <br /> 5.That Lake Fisher on Yadkin Co]dwater Creek and its drainage area above the dam <br /> be classified as a WS ~It Watershed. <br /> 6. That Luke Concord and its dr~in@pe are~ above the ({all, be separated frul,, thy <br /> Yadkin Co]dwater Creek Watershed, be designated as the "Yzdkin Patterson <br /> Branch I~atershed", and be classified as a WS IV 14atershed. <br /> · 7. That the Yadkin Dutch Buffalo Creek Watershed be designated as a l~S II <br /> Watershed. <br /> /8. That the definition of "critical area" be the area extending one-half (]/2) <br /> mile from the normal pool elevation rather than one (1) mile. <br /> 9. That the definition of "existing development" be rewritten to recognize <br /> ~ additional legal and traditional concepts of vested rights and be tied to the <br /> actual or mandatory date of local ordinance adoption whichever comes first. <br /> 10.That 1LA NCAC 2B.O104(t), purporting to require Rule compliance for new <br /> / developments in water supplies occurring after September 30, 1991 but before <br /> local ordinances are in place and. threatening sanctions against local <br /> <br /> <br />
