12 February 1990

TO: Michael M. Ruffin, County Manager
FROM: Cynthia L. Eades, Personnel Officer~

SUBJECT: County Personnel on Active Military Status

Article VI, Section 26 of the Cabarrus County PersOnnel
ordinance allows a county employee who is a member of the
National Guard or Armed Forces Reserve up to ten days per year
paid leave for military training. Our reservists serving in the
Persian Gulf were called to active duty, with no training period
preceding the call to active duty. Since a reservist, as a
result of active duty, will not be involved in the annual ten day
required military training, the question has been raised as to if
we can count ten days of active duty each year as military
training and therefore pay the reservist for those ten days.

As a matter of law, we are not required to continue to pay
or supplement a rese~,,iet's salary while the reservist is on
active duty. If we choose to do so, it would be a ~olicy
decision made by our Board of Commissioners. For comparative
information, the State of North Carolina is allowing state
employees t6 count twelve days of active duty as military
training and is paying the employees for those twelve days.
