Planning and Zoning Commission Minutes <br />May 15, 1991 paqe 17 <br /> <br /> Mr. Amos asked Mr. Marshall if the Board has anything in <br /> Robbie Faggart's letter that states utilities are <br /> traditionally handled by easements and if a right-of-way <br /> werethat easement? required, id that in the ordinance, do we require <br /> <br /> Mr. Marshall stated the people regulating the utilities <br /> themselves would require those easements, and we also in <br /> the Mobile Home Park Ordinance address easements. <br /> <br /> Chairman Randall asked the Board if they would feel more <br /> comfortable delaying this until they have a chance to <br /> read the Mobile Home Park Ordinance. <br /> <br /> Mr. Amos stated he would personally <br /> like <br /> to <br /> delay <br /> it <br /> until the next meeting. <br /> <br /> Chairman Randall opened the public meeting on Petition <br /> 91-01(M) asking if any one would like to speak for or <br /> against this petition. <br /> <br /> Mr. Alex Rankin, Concord Engineering, addressed the Board <br /> stating he is Robbie's Engineer on this project. <br /> Typically on easements, power is a blanket easement <br /> because be rerouted anytime. The prime reason <br /> power <br /> can <br /> Robbie and the planning staff is asking for this change <br /> is that there is a conflict in the ordinance. This <br /> ordinance was originally written with 4,000 square foot <br /> lots for single wide homes and 5,550 or 6,000 square foot <br /> lots for double wides. The ordinance was changed to <br /> 5,000 square feet for all lots. The base setback line is <br /> specified in the ordinance from the edge of the pavement, <br /> and that specifies where the trailer sets on the lot. <br /> There is a conflicting statement in this ordinance as it <br /> was revised that also says that the base setback lines is <br /> at the edge of the right-of-way. If you put a right-of- <br /> way on there which you do not need, you push the trailer <br /> 12 1/2 feet further back on the lot, it does not <br /> decrease the size of the lot you have, but it decreases <br /> the size of the trailer you have on this same legal size <br /> lot. That is the reason Mr. Faggart is requesting this <br /> change. <br /> <br /> There being no further comments, Mr. Amos MOTIONED to <br /> approve Petition 91-01(m) Mobile Home Park Ordinance Text <br /> Amendment, contingent on removing requirement 21 <br /> concerning the right-of-way and substituting a <br /> requirement that minimum easements for all utilities be <br /> shown on the plat, seconded by Mr. Olio-Mills.
