Page 6 of 6 <br /> ! <br /> <br /> (b) The Center shall keep such records and submit <br /> such reports concerning the characteristics of applicants for employment <br /> and employees as the Purchaser and the North Carolina Division of Aging may <br /> require. (c) The Center agrees to comply with such guidelines as the <br /> Purchaser or the North Carolina Division of Aging may issue to implement <br /> the requirements of this paragraph. (d) The Center agrees to comply with <br /> Title VI and Title VII of the Civil Rights Act and Section 506 of the <br /> Rehabilitation Act. <br /> <br /> 14. Indemnity and Insurance. The Center agrees to indemnify and save harmless <br /> the Center, its agents and employees from and against any and all loss, <br /> cost, damages, expense, and liability caused by the failure of the Center <br /> to fully perform its obligations under this agreement and in accordance <br /> terms; or by an or other occurrence causing bodily <br /> its <br /> injury, including death, sickness, and disease to any person; or damage or <br /> destruction to property, real or personal, which may arise from operations, <br /> products or services rendered under this contract. <br /> <br /> 16a. Indemnity and Insurance. The Purchaser agrees to indemnify and save <br /> harmless the Center, its agents and employees from and against any all <br /> loss, cost, damages, expense, and liability caused by the failure of the <br /> Purchaser to fully perform its obligations under this agreement and in <br /> accordance with its terms; or by an accident or other occurrence causing <br /> including sickness, to any person; or <br /> bodily <br /> injury, <br /> death, <br /> and <br /> disease <br /> damage or destruction to property, real or personal, which may arise from <br /> operations, products or services rendered under this contract. <br /> <br /> 14b. The Center at its own expense shall procure and maintain for the duration <br /> of this contract for Comprehensive General Liability including coverage for <br /> personal injury hazards A, B, and C products and completed operations and <br /> contractual liability assumed under the indemnity provision of this <br /> contract for limits of not less than $500,000 bodily injury liability each <br /> occurrence/aggregate and Assurance statements shall be furnished by the <br /> Center reflecting such coverage prior to payment of funds under this <br /> any <br /> contract and shall contain the provision that the Purchaser be given thirty <br /> (30) days written notice of any intent to emend or terminate such policies <br /> by either the Center or the insuring company. <br /> <br />! <br />! <br />! <br />! <br />I <br />! <br /> <br /> <br />
