SECTION 5.5 VESTING DEVELOPMENT RIGHTS <br /> <br />A developer/owner may establish a vested right to complete their development <br />project by submitting a site specific plan. A public hearing must be held by the <br />Planning and Zoning Commission to review end approve the site specifio plan. <br />Any variations from the original plan taus! have the consent of the P]auning and <br />Zoning Commission. All suits at low or inequity and/or all prosecutions resulting <br />from the violation of any subdivision ordinance heretofore in effect, which are <br />now pending in of the courts of this state or of the United States si~all not <br /> any <br />be abated or abandoned by reason of the adoption of this ordinance, but shall <br />be prosecuted to their finality the same as if this ordinance lind not been <br />adopted, and any and all violators of the existing ordinance prosecutions for <br />which have not yet been instiluted may be hereafter filed and prosecuted, and <br />nothing in this ordinance shall be construed as to abandon, abate, or dismiss <br />any litigation or prosecution, now pending and/or which may heretofore have <br />been instituted or prosecuted. <br /> <br />SECTION 5.7 GRIEVANCES <br /> <br />Any person that is aggrieved by the decision of the Planning and Zoning <br />Commission as it relates to this ordinance, may within thirty (30) days of <br />Planning and Zoning Commission's decision, petition lbs Board of County <br />Commisslouers for their interpretation of the Planning and Zoning Commission <br />decision. <br /> <br />SECTION 5.8 EFFECTIVE DATE <br /> <br />This ordinance shall take effect and be in force from and after: <br /> <br />Dale Chairperson of County Commissioners <br /> ~5 <br /> <br /> <br />
