The vote was 9-0. <br /> <br />Chairperson Randall introduced the fifth item on the Agenda, Text <br />Amendment, Petition 91-02 (t): <br /> <br />5. ~pplicant: Cabarrus County Planning & Zoning <br /> Department <br /> Request: 10.15 Vesting of Development Rights <br /> <br /> This was a request to the Cabarrus County Planning and <br /> zoning commission from the Cabarrus County Planning and <br /> Zoning Department to allow a developer/owner to establish <br /> a vested right to complete a development project by <br /> making a formal request to the Planning and Zoning <br /> Commission. The request shall contain: <br /> (1) A description with reasonable certainty, the type <br /> and intensity of a use for a specified parcel(s) of land. <br /> (2) "Site Specific Plan" or "Phased Development Plan" <br /> which shall be in the form of a subdivision plat drawn in <br /> accordance with the Cabarrus County Subdivision <br /> Regulations or a site development plan drawn in <br /> accordance with Section 5.4 and Section 5.5 of this <br /> ordinance. <br /> <br /> Upon receiving a request for vested rights, the Planning <br /> and Zoning Commission shall hold a public hearing to <br /> review the submitted plans. If the plans are approved; <br /> the vested rights shall run with the land for a period of <br /> two (2) years, beginning from the date of approval. <br /> <br /> ~n~ variations from the original plan must have the <br /> consent of the Planning and Zoning Commission. <br /> <br /> Mr. Marshall stated that this text amendment is the <br /> result of some recent legislation requiring that a method <br /> be inserted in zoning ordinances or applicable ordinances <br /> to allow for property owners or developers to vest their <br /> zoning rights. In other words, to guarantee their rights <br /> under their current zoning.
