Planning and Zoning Commission
September 19t 1991 Paqe 15

Mr. Alexander stated to the Chair that it would be
helpful if she would give the petitioner the opportunity,
it may be necessary for the petitioner to confer with
council, as to what decision they need to take.

Chairperson Randall stated first they have a motion to
table if that motion is approved, part of our zoning
regulations specified, that if we have not taken action
on the petition within 30 days, which we would not if we
table, the recommendation will be a f~vorable
reco~unendation to the County Commissioners. However, if
the motion to table was withdrawn then what we would be
doing, we would be actually at this point, voting on the
motion that was made by Mr. Hurlocker which was a motion
to approve. There is always the possibility that the
petitioner would choose to request to the Board that the
action on this be deferred, that will not be tabled by
this Board, it would be a deferral at the request of the
petitioner. Those are options she sees that may occur
and that the Board may need to consider.

Mr. Alexander stated there obviously is a motion and a
.second to simply approve this petition. There is also a
motion and second to table this He would
a
petition.
surmise that the reason for the motion to table is
primarily to give Board members an opportunity to place
conditions on their approval of the zoning change. What
the zoning ordinance tells the Board is that they cannot
table this matter for 30 days without, in essence,
without their actions going forward to the Board of
County Commissioners with a favorable report. You as the
petitioners could ask that it be deferred so that this
provision in the ordinance would not come into effect,
you could come back next month with your site plan and
hopefully alleviate any problems the Board members may
have in satisfying the conditions they wish to place on
this request, if they so desire. So basically, you can
take the initiative to ask that it be deferred until the
next meeting. If you do not do so, then because of the
precedent of the motion, the Chair must consider the
motion to table, then depending on that motien, she would
go back to the original motion to approve.

Mr. Grady asked for a motion to recess to talk with the
petitioners.
