This is a rezoning of a special use. <br /> <br /> There being no further comments, the vote was approval 5 <br /> to 4. Mr. Hurlocker, Ms. Harkey, Mr. Olio-Mills, Mr. <br /> Smith and Ms. Barbee for the petition; Mr. Hartgen, Ms. <br /> Randall, Mr. Amos and Mr. Shultz against the petition. <br /> <br />Chairperson Randall introduced the fourth item on .the Agenda, <br />Zoning Text Amendment, Petition 91-03(t): <br /> <br />4. Applicant: Cabarrus County Planning & Zoning <br /> Request: Thoroughfare Overlay Zone <br /> (TOZ) <br /> <br /> This was a request to the Cabarrus County Planning and <br /> Zoning Commission from the Cabarrus County Planning and <br /> Zoning Department to change 3.11 Thoroughfare Overlay <br /> Zone (TOZ) to make county regulations more in line with <br /> NCDOT regulations. <br /> <br /> Mr. Downs, Zoning Administrator, addressed the Board <br /> stating the majority of the changes have been <br /> capitalized. There is one other additional change that <br /> is not in capital letters. What the staff has done is <br /> met %¢ith the Department of Transportation and District <br /> Engineer, Larry Gordon, and had them to review the <br /> County's overlay zone, and their col~ents were it is <br /> impossible to make someone close their driveways once <br /> their business is intact. What the staff has done is <br /> gone thoroughfare overlay zone and made <br /> back <br /> through <br /> the <br /> driveway cuts that must be approved by the Department of <br /> Transportation. What the staff is suggesting is that the <br /> setbacks be calculated from the new proposed right-of- <br /> way. <br /> <br /> Chairperson asked Mr. Downs what will this essentially <br /> do, will this allow existing businesses to go through <br /> additions to their property. If you are starting a <br /> business on Highway 24/27 would you be allowed to have <br /> two driveway cuts? <br /> <br /> Mr. Downs stated that is one of the other major changes, <br /> that is any lot of record, with existing businesses, <br /> which is in Section 3.11-5, the existing business: 1. <br /> any lots of record at the time of adoption of this <br /> section shall be permitted excess in conjunction with the <br /> approved driveway permit. If they are existing we would <br /> require that you go back to DO~ <br /> <br /> <br />
