The recipient shall also comply ~ith all other la~ful requirements of ECD, all applicable requirements of the General Statutes of the State of North Carolina and any other applicable laws and Executive Orders currently or hereafter in force. Oblig!tinp~ of Recipient vith Respect to Certain Third Party Relationshivs. ECD shall hold the recipient responsible for complying ~ith the provisions oi this a~reement even when the recipient designates a third party or parties to undertake all or any part of the program. The recipient shall comply ~ith all la~ful reqoirements of ECD to insure that the necessary program is carried out in accordance with the recipient's certifications including the certification of assumption of environmental responsibilities under Rule .tOO& of the North Carolina Co.unity Development Block Grant Ad~inistratlve Rules, I NOlO ~gL ' Con~llet of Ipterest. ~one of the follo~inl or their i~'~edlate family ~embers, during the tenure of the subject person or for one year thereafter, shall have any direct or indirect financial interest in any contract, s~bcontract or the proceeds thereof for ~ork to be performed in connection ~ith the program assisted ~nder this agreement: employees or agents of the reclpie~t ~ho exercise any function or responsibility ~ith respect to the prn2ram, and officials of the recipient, including members of the governing body. The same prohibition shall be incorporated in all such contracts or s~bcontracts. The assistance provided under this agreement shall not be used in the pa)'ment of any bonus or coramissioo for the purpose of obtsinin& ECD approval of the application for such assistance, or £CD approval of applications for additional assistance, or any other approval or concurrence of ~CD required under this agreement, or the North Carolipa Cook, unity Development Block Grant Administrative Rules, ~ith respect thereto; provided, hovever, that reasonable fees or bona fide technical, consultant, managerial or other such services, other than actual solicitation, are not hereby prohibited if othervise eligible as program costs. Reimbursement to ~D for Improper Expenditures. The recipient ~ill reimburse SOD for any a~ount of Erant assistance improperly expended. ~ccess tO Records. The recipient shall provide any duly authorized represeotative of ZCD, ROD and the Comptroller Genersl at all reasonable times access to and the right to inspect, copy, monitor, and examine all of the books, papers, records, and other documents relating to the grant for a period of three years following the completion of all closeout procedures.
