Page 7 of 15 <br /> <br /> Circular A-128, "Audits of State and Local Government", dated <br /> <br /> April 2, 1985, and the Single Audit Act of ]984, the Contractor shall <br /> arrange for an independent financial and compliance audits of its fiscal <br /> operations. The Contractor shall furnish the Department with a copy of the <br /> independent audit report within thirty (30) days of completion of the <br /> report, but no later than one (1) year after the end of the audit period. <br /> <br /> Section 7. Contracts Under This Aqreement. Unless otherwise <br />authorized in writing by the Department, the Contractor shall not assign any <br />portion of the work to be performed under this Agreement, or execute any <br />contract, amendment, or change order thereto, or obligate itself in any <br />manner with any third party with respect to its rights and responsibilities <br />under this Agreement without the prior written concurrence of the Department. <br />Further, the Contractor shall incorporate the provisions of this Agreement <br />into any vehicle lease arrangement and shall not enter into any vehicle lease <br />arrangement without the prior concurrence of the Department. Any lease <br /> <br />approved by the Department shall be subject to the conditions limitations <br /> or <br /> <br />governing the lease of Project equipment as set forth by UMTA and the <br />Department. <br /> <br /> Section 8. Purchase of Project Equipment. The purchase of project <br />equipment pursuant to this Agreement shall be undertaken in accordance with <br />either of the options in this Section: <br /> <br /> (a) Purchase by the Department. The Department may act as the <br />procurement agency on behalf of the Project, purchasing equipment through <br />the North Carolina Department of Administration, Purchase and Contract <br />Division. <br /> <br /> (b) Purchase by the Contractor. The Contractor may purchase project <br />equipment utilizing procurement procedures set forth in North Carolina <br /> <br /> <br />
