WATER SUPPLY WATERSHED PROTECTION <br /> House Bill 156 <br /> Ratified - June 23, 1989 <br /> <br />Purpose: <br /> <br /> The purpose of this Act is to protect and enhance the quality <br /> of the State's surface water supplies by establishing a <br /> cooperative program of water supply protection to be <br /> administered by local governments consistent with statewide <br /> management requirements established by the Environmental <br /> Management Cor~ission <br /> <br />Specific Provisions: <br /> <br /> Development and Adoption of Rules - The EeC will adopt rules <br /> for classification an~ protection of surface water supplies. <br /> <br /> Classification of Water Supply Watersheds - The EeC will <br /> assign to each water supply watershed the appropriate <br /> classification for the minimum prote~tive management <br /> requirements. <br /> <br /> Mandatory Local Programs - All local governments with <br /> jurisdiction in a water supply watershed must develop <br /> watershed protection programs that include an ordinance and <br /> provide for maintenance, inspection and enforcement <br /> procedures. The EeC will provide local governments with model <br /> ordinances. Ail local programs must be approved by the EMC. <br /> <br /> Enforcement - The EMC may assume responsibility for watershed <br /> protection where local governments fail to adopt or properly <br /> administer and enforce adequate programs. The EeC may also <br /> mmpose civil penalties in conjunction with violations. <br /> <br /> Advisory Council - An advisorY council of 19 members, <br /> appointed or designated as outlined in this act, was <br /> finalized in December 1989. The Council will assist in <br /> development of watershed protection rules and other <br /> d~signated matters. <br /> <br /> Important Dates <br /> <br /> By January 1, 1991: EMC adopts surface water <br /> supply watershed classifi- <br /> cations and associated <br /> management requirement rules <br /> <br /> By January 1, 1992: EeC classifies all water supply waters <br /> <br /> By July 1, 1992: Affected local g.overements <br /> must submit watershed <br /> protection ordinance to the <br /> EeC for approval <br /> <br /> For more information, please contact Steve Zoufaly, <br />Department of.
