Matthews J~.~.~, <br /> <br />Please take note of the following: <br /> <br /> 1. The NC Legislative Study Commiseion on <br /> Surface Water will have its final meeting, <br /> before the General Assembly convenes, on <br /> Monday,' April 23, at 10:00 a.m. in Room 1124 <br /> of the Legislative Building in Raleigh. Please <br /> all who can try to be present. <br /> <br /> 2. The Office of Administrative Law Judge has <br /> ruled the Yadkin-Pee Dee River Basin Committee <br /> and the Friends of the Dan/Mayo Rivers Basins <br /> Committee cannot be a direct party to the legal <br /> proceedings relative to the Cary/Apex Project. <br /> <br /> This ruling was made because the membership of <br /> the committees would not, supposedly, be <br /> adversely affected because the membership of <br /> the two committees are not "down stream" from <br /> the Jordan Lake. The committees had contended <br /> that this was ~ statewide issue in terms of the <br /> decision havin~ long range effects in North <br /> C~rolina. <br /> <br /> 3, The Administrative Law Judge did rule that <br /> information would have to be provided by the <br /> NC Environmental.Management Commission as to <br /> how they reached a decisio~ to approve the <br /> transfer of water from the. Cape. Fear River to <br /> the Neuse River. This would include, <br /> communications between the NC Enviromental <br /> Management C~mmission ~nd Apex and Cary <br /> officials and whether EMC members had conflicts <br /> of interest etc. The attorneys for the <br /> E~vir~nmental Management Commis$ionl do not Want <br /> this ~nforma~ion to be made public for obvi6us <br /> re.asons. <br /> <br /> <br />
