Planning 8oard Minutes
May l~_~ 19~0 ~ Paqe 3

enterprises which were non-conforming under tho C-5 classification. The
text alaendment change which was made in 1988 to make this perl, itted use
was a way of getting the change made without the general cm,uaunity notice
that is given in case of an atlas cllange. The co,m~uoity was unaware of
this cllange.

Mr. Amos said there are two key points that he thinks are important wily
the permitted use in C-§ sllould be deleted. First is to .insure that the
pertaitted uses are consistent ~itll the intent of the district; and
second, to coaalunieate to our citizeos that we do in fact @laCe the
general benefit of tile coa~nunity over individual interest.

Ms. Kay Amos, Co-Petitioner, stated the reason they th~nk that there
definitely should be a deletion of the use is specifically wllat has
been sited at tile meeting tonight. These changes had bee~ asked for
in public planning sessions three different times because there was
an existing business there and tile person wanted to expand it, Ms.
Amos asked that tile Board delete that use fro~ll the existing ordinance.

l~here being no further comments, Mr. Hurlocker MOTIONED, seconded by
Mr. Suther to deny Petition gO-Oq(t) zoning text amendment and instruct
the Staff to study tile zoning at tile intersection of Highway 73 East
and Cold Springs Road, and to present their recommeodations to the
Board. The vote was unanimous.

Mr. Newton, Planning and Zoning Director, stated the Staff will work
on a small area plan for that intersection. It would take about two
months to process, and it will come before the Board at the July
Planning Board meeting.

Chairman Randall introduced tile third item on the Agenda, Final Plat ~.pproval:

3. Applicant: S.P.D.1. P__a_r. tnershi_p/~Bill Whitlej<
Request: ~roval of Final Pla~

lois was a request to the Cabarrus County Planning Board from S.P.D.I.
Partnership/Bill Whitley to have his subdivision pla; Britley 1
(formerly Fox Meadow) approved final.

Staff Member, Jonathan Marshall, presented the Final Plat.

~here being no comments, Mr, Moose MOTIONED, seconded by Mr. Suther
to approve Britley I (foramrly Fox Meadow) subdivision plat final,
contingent on the restripin9 of Robinson Church Road to provide a left
turn lane and the provision of a temporary turnaround on Britley Lane.
~ho vote was onaoimous.
