Mr. NeWton sta~ed ~haL Cold S~r~ng~ ROad <br /> is a road that is well &raveled, and ~be fact that it ~s a major road <br /> ~ntended to serve the traffic in the north/sourly, U~at would h~dica~e <br /> tha~ at some future point and time, it w~]] become co~m~ercla] (~eighborhood <br /> Co~m~ercia 1 Node). <br /> <br /> The chairman opened the Public Hearing on Petition 90-09 asking if anyone <br /> would like to speak for or agai.nst this Petition. <br /> <br /> Ms, Fred He}ntz, Petitioner, addressed the BOard on beba]f of her <br /> petition stating this property I~as been a col~mlercial business for <br /> 20/25 years. The building is a $60,000/$65,000 building and she cannot <br /> se]] or rent it if ~ is no~ rezoned, and that puts a hardship o~ her. <br /> <br /> Mr. Newton, Planning and Zoning Director, stated the staff is trying <br /> in a rezoning reguest, l~ok a~ the reasons ~ha~ a rezoning shoul~ <br /> normally occur: has there been a change in the area that wasn't anticipated <br /> when the Comprehensive Plan was written. In the Staff's Analysis there <br /> wasn't really a change that has bappen since ~hat was done. The S~aff <br /> see no reason tO change the zone. <br /> <br /> The,e being no further comments, Mr. tlurlocker MOTIONED, seconded by <br /> Mr. Suther ~o conform with the reco~imlendation of the Planning Staff to <br /> deny Petition 90-09 zoning atlas amendment. The vote was unanimous. <br /> <br /> Chairman Randall introduced the second item on the Agenda, Zoning Text <br /> Amendments: <br /> <br /> 2. Applicant: Robert T. Amos <br /> Request: 3.2-4. Schedule of Use Regulations <br /> <br /> This was a reguest to the Cabarrus County Planning Board frOm Robert T. <br /> Amos to change line item on page 11H in the zoning ordinance: Plumbiu9 <br /> and Heating Supply Stores - Delete as Permitted Use in the C-5 Zone. <br /> <br /> Staff Member, Jonathan Marshall, presented the Staff Analysis. <br /> <br /> The Chairman opened the Public Hearing on Petition 90-04(t), asking if <br /> anyone would like to speak for or against this Petition. <br /> <br /> Nr. Bob Amos, Petitioner, stated {as Jonathan mentioned), the Planning <br /> Board concurred that the use does not meet tbe intent of the <br /> District. I~hile changes ~ill be made in the future, Mr, Amos said we <br /> should address the zoning ordinance as it presently stands for <br /> consistency with &he district rather than'just leave it (status quo). <br /> Mr. Amos said tbe p[,rmitted use does not benefit tile general commmlity. <br /> Tills area has bad a ~is~ory o1' rezonings that attempted to expand <br /> <br /> <br />
